1. Who you are contracting with
Wheelhouse (the "Service") is operated by Brandon Dasan Sitzes("we", "us", "our"), a sole proprietor. By creating an account, signing in, or otherwise using the Service, you agree to these Terms & Conditions. If you are using the Service on behalf of a company or vessel operator, you represent that you have authority to bind that organization.
2. The Service
Wheelhouse aggregates crew-sourced bridge clearance readings, active river closures, and captain-reported difficulties on US inland waterways. Information is provided as decision support only. You are responsible for verifying all conditions with the US Coast Guard on VHF Ch 13/16 and with bridge tenders before navigating. We do not guarantee accuracy, completeness, or timeliness of any data on the Service, and the Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
3. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of maritime regulations;
- submit false, misleading, or fraudulent reports, clearance readings, or passage logs;
- scrape, probe, or attempt to interfere with the security or integrity of the Service;
- upload malware or attempt to gain unauthorized access to any account, server, or data;
- infringe any third party's intellectual property or privacy rights; or
- resell, redistribute, or sublicense the Service or its data without our written consent.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it current.
5. Intellectual property
We retain all right, title, and interest in the Service, including its software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service under your chosen plan. You retain ownership of the content you submit (such as passage logs, closure reports, and vessel details), and you grant us a limited license to host and process that content solely to operate and improve the Service.
6. Subscriptions, billing, and payments
Paid plans (monthly, yearly, and lifetime "Pro" plans) are sold through our online reseller, Paddle. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically at the interval you selected until you cancel. 7. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Service level and availability
We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. Data feeds may be delayed, incomplete, or unavailable. You must never rely on the Service as the sole source of navigation safety information.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay fees when due, pose a security or fraud risk, or repeatedly or seriously violate our policies. On termination, your right to use the Service ends immediately; you may request an export of your submitted data within 30 days after termination, after which we may delete it.
10. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in the Service constitutes navigational advice.
11. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claims arising out of or relating to the Service will not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, goodwill, or vessel-related losses. Nothing in these Terms limits liability that cannot be limited under applicable law (including for fraud, death, or personal injury caused by our negligence).
12. Indemnity
You will indemnify us against claims arising from your submitted content, your unlawful use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Louisiana, USA, without regard to conflict-of-laws principles. The courts located in Louisiana have exclusive jurisdiction over any dispute arising out of these Terms.
14. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
15. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, government action, or upstream service outages.
